Abstract

This article aims to demonstrate the type of evidence in kind provided for in the code of civil procedure that is also provided for in the constitutional text. For this purpose, general aspects of testimonial evidence will be studied initially, seeking to understand the current concept of the term. In the second part of the work, a question will be asked about the type of evidence as an instrument of use in the legal environment, especially regarding the means of admissibility, as well as the use of a witness as a means of proof in a dispute. in the research the bibliographic referential methodology, using books, articles and works that deal with the subject studied and the Brazilian legislation.
