AMPARO ESTATAL AOS MILITARES TEMPORÁRIOS DAS FORÇAS ARMADAS ACOMETIDOS POR DOENÇA OU ACIDENTE COM E SEM RELAÇÃO DE CAUSA E EFEITO COM O SERVIÇO

Abstract

The context of this study works with two basic pillars: the structure of the Armed Forces and their working relations with the military classified as temporary careers. The question that has been speculated is about the possibility of verifying whether state support is available to the temporary military personnel of the Armed Forces, affected by illness or accident, with and without a cause and effect relationship with the service? In this context, the objective was to verify the legal regime applicable to the temporary military, aiming to understand what the state protection is due to the temporary military affected by illnesses and / or accidents, whether temporary or permanent, with the service and the legal institutes applied to each case. The research has a descriptive nature based on Boaventura (2004) and Pádua (2016), for which this model aims to present a theme or phenomenon, allowing it to become clearer or be better understood. A first action is centered on the conceptual analysis carried out on publications that characterize the armed forces' organizational model, based mainly on the publications of Mintzberg (2003). From the analysis, it was verified the responsibility of the State to provide the necessary support to the temporary military affected by illness or accident with and without cause and effect relationship with the service through the aggregation / addition in the case of temporary disability or retirement when having permanent disability it is enough to prove that the military joined the ranks of the Armed Forces with full health, physical and mental strength and that the accident or incapacitating illness occurred during the period in which he was performing active service.
